Responsibilities:
Leads, drives and enhances the Compliance program to ensure business practices and activities are in compliance with related EssilorLuxottica internal policies and procedures, local laws, regulations and anti-corruption laws; serving as a strategic business partner for advising and guiding employees and partners, to effectively prevent and/or detect violations of law, regulations, internal policies and procedures.
This position reports to the Compliance Associate Director, AMERA & China (the “Manager”) and will cover the following regions: China, Hong Kong and ***.
1) Implement EssilorLuxottica’s Compliance policies, procedures, systems and processes to ensure appropriate gatekeeping mechanism in place to promote an ethical culture (30%)
- Support implementation and governance of the Group’s Compliance program and seek continuous improvement of the program to ensure compliance within the designated countries
- Support identification of compliance vulnerability and risks; develop and implement associated risk mitigation programs and/or processes in areas such as anti-bribery, anti-corruption, economic sanctions and medical affairs and marketing activities
- Support designing, managing and deploying effective compliance training, communication and customized programs suitable for the designated countries and/or targeted teams and leaders
- Provide reports on a regular basis, or as requested, to keep the Manager and/or senior management informed of the operation and progress of Compliance efforts.
- Work with diverse regional team of compliance professionals and cross-functional project teams, as needed, to effectively implement compliance initiatives
- Provide guidance and coordinate with local gatekeeper functions (e.g., Finance, Legal and Human Resources teams, etc.) to monitor the performance of the Compliance program in particularly relating to ethics, business conduct and compliance matters
- Keep abreast of developments in laws and regulations, industry trends, risks and best practices
2) Support deployment of the EssilorLuxottica data protection program in the designated countries (10%)
- Assist deployment of standard policies, practices and standard documents and support development and implementation business specific policies and SOPs and customize global/regional policies, procedures, as needed
- Prepare training and communication materials to reflect local requirements and provide training and communication to enhance awareness; in particular, to permissible medical education and marketing activities
- Conduct assessments and audits to identify areas of risks and possible exposure of entities within the designated countries
- Support development and implementation of an effective data protection program, including but not limited to, appropriate introductory and awareness training and communication
3) Support implementation of compliance program in medical affairs and marketing activities (60%)
- Understand and support business strategies related to medical education and marketing projects and managing related Compliance risks by providing guidance
- Support implementation of framework on review and guidance of permissible types medical education and marketing activities relevant to Greater China region
- Periodically reporting to the Manager on development related to medical education and marketing projects and business strategies/objectives
Requirements:
- Accounting and/or Legal degree required (with audit or forensics background)
- Experience in all elements of an effective Compliance program
- Broad business experience and a proven ability to influence business decisions and lead employees and business partners to drive implementation of company-wide Compliance program
- Proven track record in delivering results, in particular in medical education compliance
- High level of integrity with strong ethical core values and ability to uphold them in occasions of pressure
- Clear and persuasive communicator
- Possesses organisational, analytical and interpersonal skills and detail-oriented
- Independent and objective thinker, capable of making strategic decisions based on the local legal, business and market environment to advance and influence others
- Ability to work effectively with both local and international regional stakeholders, maintaining effective partnerships and working relationships with key stakeholders at all levels of organisation, based on an understanding of their concerns, needs and motivations
- Manages conflicts in an open and constructive manner
- Result- and solution-orientated with ability to take complex business situations and develop solutions to ensure compliant growth is achieved
- Fluent in English and Chinese (reading, writing, verbal)
